1. Background
GrapePip is the trading name of GrapePip Ltd, a company registered in England & Wales, Company No. 07629001, Registered Office Address: GrapePip Ltd, 29 Gay Street, Bath, BA1 2NT.

2. Using GrapePip
In order to use the services and facilities provided by our website, you are required to Register and set up an account which will contain your personal details. 

By registering to use our website as a Buyer, you confirm that you are at least 18 years old.
By registering to use our website as a Vendor, you also confirm that you have the legal capacity to bind the business you are representing. You also confirm that you are legally able to sell the item(s) you list for sale on our website.

You are specifically forbidden from opening or attempting to open more than one account, other than where you are operating separate accounts for your business and personal use.

It is recommended that you do not share your account details, particularly your username and password, with others. GrapePip accepts no liability for any losses or damages incurred as a result of your account details being shared by you. If you have reason to believe that your account details have been obtained by another without your consent, you should contact GrapePip immediately in order to suspend your account and cancel any unauthorised bids that are in progress or purchases that may be pending. In the event that unauthorised use is made of your account, GrapePip accepts no liability or responsibility for that.

3. Lot Descriptions
Vendors must make every attempt to describe all lots as accurately as possible. We review all lots prior to making them live on the website; the review process involves the checking of wine descriptions and prices. In the event that the Vendor has provided false information, or merely erroneous information, the Vendor is liable for all subsequent costs incurred.

Similarly, if the Vendor sells a lot on GrapePip which the Vendor is subsequently unable to supply, all costs incurred in resolving this matter are the liability of the Vendor.

All statements made relating to wines for sale on this website, such as tasting notes and wine reviews, are merely statement of opinion and at no time can be construed as warranties or representations of fact.

4. Photos
When a lot description includes a photo, the photo may not necessarily show the actual bottle/case of wine offered in the lot; the photo may be a stock photo of the specified wine and vintage.

5. Provenance
GrapePip is 100% confident about the provenance of all wines for sale on our website. All wines made available for sale via GrapePip are lying in professional storage facilities including, but not limited to, Octavian, LCB Tilbury, LCB Vinotheque and EHD, and have been in professional storage since shipment to the UK. Documentation is available on request for all wines listed. 

Trade Vendors must be UK-based wine merchants; all merchants are thoroughly vetted prior to being accepted as Vendors on GrapePip.
Private Vendors will be required to provide proof of provenance and storage for every wine listed on GrapePip.

By ticking "I have read & accept the Terms & Conditions" when registering to be a Vendor, both Trade and Private Vendors are confirming their responsibilty to only list Wines of Perfect Provenance on the site. Any Vendor found to be flouting this rule, will instantly have their Vendor status revoked. 

6. Prices
All GrapePip auctions are conducted in UK pounds sterling and all charges, relating to duty, VAT and delivery, are in UK pounds sterling.

The Vendor chooses the Reserve Price, the Starting Price, the Bid Increments and the Buy Now Price (if chosen) for all of their lots on GrapePip. 

Our standard commission rates are as follows and are liable to VAT:
Vendor's Commission - 5% of the final hammer price
Buyer's Commission - 5% of the final hammer price.

7. Bidding process
By bidding on a lot as a Buyer, you agree to be bound by the conditions of sale; you accept that the bid is final and that the Buyer will not under any circumstances be able to amend or retract the bid. If you have the highest bid at the end of the auction, at or above the Reserve Price, you are deemed to be the Buyer and are obliged to complete the transaction; you thereby agree to pay the full purchase price, including the Buyer's 5% commission, all applicable taxes and delivery charges.

8. Misuse of GrapePip
Whilst using GrapePip, you will not:
a) manipulate the price of any item, or interfere with other listings on GrapePip;
b) partake in Shill bidding (when you or someone you know bids to artificially drive up the price of a lot);
c) use an alias to place bids on your auction for any reason;
d) disclose or share your password to any third parties or use your password for any unauthorised purpose;
e) display contact details within your auction listings or use a listing to solicit potential buyers.

GrapePip reserves the right to monitor all bids placed and all purchases completed on our website, and to disable a user's account if they are misusing our site in any way. 

When an auction ends, the Buyer is notified by email. You are then required to complete the transaction by logging on to your account on the website. Once delivery instructions are specified, the total amount payable is calculated. This final amount must be paid within 7 days of the auction closing. GrapePip reserve the right to disable a Buyer's account if they repeatedly fail to adhere to our payment terms.

We accept payment via PayPal (GrapePip does not have access to a user's credit card details but uses PayPal for all payment processing; no card details are stored electronically by GrapePip) or via Bank Transfer. Full bank account details are specified on the final stage of the checkout process but can also be found below:

Once payment has been made, a PDF invoice can be downloaded from My Accounts/Order History.

With regards to vendors receiving the proceeds from their sales, GrapePip does a weekly payment run on a Wednesday for any wines physically received in our warehouse accounts during the preceding 7 days. Vendors are emailed a Statement of Account showing any sales and susbequent commission payments; the balance owing is paid by GrapePip, via bank transfer, on that same day. 

10. Status
The duty status of the wine is stated within the lot details. It is the Buyer’s responsibility to note the duty status of the wine prior to bidding on the wine. The Buyer assumes full responsibility for any duty and VAT applicable, i.e. if the wine is sold lying under bond but the Buyer wants to take delivery to a duty paid address.

11. Shipment
The location of the wine is similarly stated within the lot details. It is the Buyer’s responsibility to look at the location of the wine prior to bidding on the wine.

The Buyer assumes full responsibility for any delivery charges incurred in moving the wine from the current warehouse location to the required warehouse or home address. The wine will only be delivered upon receipt of the total amount payable.

Please allow 14 days from the date of payment to dispatch of your wine. In most cases, delivery is achieved much more quickly than this but we have to allow this timescale as some of the fulfilment process is beyond our control; the Vendors acting promptly on receipt of our instructions and the bonded warehouses transferring the wine into our account before we are able to then instruct delivery according to the Buyer's instructions. 

12. Delivery Charges

To transfer a case from GrapePip's account at a specific warehouse to the Buyer's account at the same warehouse is free of charge. Other than that, the charges vary from warehouse to warehouse. 

We DO NOT ship overseas but can deliver any purchase to a UK-based shipping agent of the Buyer's choice. 

13. Cancellations & Refunds
As stated in "Bidding Process" above, if your bid is the winning bid, you are the Buyer and hereby agree to pay the full purchase price, including the Buyer's 5% commission, all applicable taxes and delivery charges. A purchase cannot be cancelled and no refunds will be issued. 

Occasionally, a Vendor may need to cancel a sale if, for example, a wine is broken, or an error has been made in the listing and the Vendor is unable to supply the wine. In such instances, the Vendor must notify GrapePip as soon as possible in order that GrapePip can notify the Buyer without delay. The Buyer will be immediately reimbursed through the same payment method used at checkout. 

14. Faulty Wines
The wine industry estimates that between 3% and 6% of all wines bottled under natural cork develop some sort of taint relating to the natural closure. Neither GrapePip nor the Vendor are responsible for wines affected by faulty corks, and the Buyer cannot claim compensation from GrapePip or the Vendor for any faulty bottles.

15. Breakages & Losses
If a wine is broken in transit, the Buyer must make the carrier aware of the breakage when accepting the delivery and it must be marked accordingly on the Delivery Note. The Buyer must in addition inform GrapePip as soon as reaonsably possible. GrapePip will then endeavour to refund the Buyer for the total purchase price including Buyer’s Premium for any broken bottles.

This website may contain links to other sites. Unless expressly stated, these sites are not under the control of GrapePip. We assume no responsibility for the content of any such website and disclaim liability for any and all forms of loss or damage arising out of the use of them.

All use of your personal information will be made in accordance with our Privacy Policy.
